A former Mott School security guard who pleaded guilty to inappropriately touching two elementary school students in 2007 will not be reimbursed for legal expenses.
TRENTON — A state appeals court ruled today that a former Mott School security guard who pleaded guilty to inappropriately touching two elementary school students in 2007 will not be reimbursed for legal expenses he incurred during a civil suit brought against him by one of the students.Logan Alexander, 65, is not entitled to a reimbursement because he cannot claim that the inappropriate touching arose out of the normal performance of his duties as a security guard, Superior Court Judges Marie Lihotz and Michael Guadagno decided.
In their opinion, the judges wrote that Alexander had actually pleaded guilty to wrongdoing, which meant that he had not acted in accord with his job requirements, and they said that the state Division of Children and Families had investigated the incidents and found clear evidence of molestation and sexual contact.
Regarding one incident involving Alexander and a 10-year-old girl, the judges wrote, “Certainly, locking the child in the teacher’s lounge where he touched her chest, thigh, shoulders and arms defies any finding the conduct resulted from his employment responsibilities.”
Alexander was initially arrested in March 2007 after a 13-year-old girl told a counselor he kissed her breast through her clothing and made sexually explicit comments to her, prosecutors said at the time.
Alexander was free on bail for that incident when a 10-year-old female student at Mott told a teacher that Alexander “restrained her” and had touched her legs and breasts earlier in the year in the teacher’s lounge, prosecutors said.
He entered a plea agreement and pleaded guilty to one count of second-degree endangering the welfare of a child.
His employment was terminated and he registered as a sex offender.
Alexander filed a petition seeking reimbursement of the legal fees incurred during the civil suit with the Horace Mann Insurance Agency, which is the school board’s liability carrier underwriter.
