HAMILTON — A 4-year-old girl has been declared brain dead a day after an alleged drunk driving crash that killed her father, state police said.

Jasmine Deleon was taken by helicopter to Children’s Hospital of Philadelphia in critical condition after the early morning crash Sunday on Route 29 near the Route 129 split.

Her father, Jorge DeLeon, 28, of Elm Street in Trenton was pronounced dead at the scene, Chief Thomas Gribbin of the Rusling Hose Fire Company in Hamilton said.

Jasmine's 6-year-old brother was taken to Capital Health Regional Medical Center in serious condition with non-life threatening injuries, including a broken right arm, the Mercer County Prosecutor's Office said.

First Assistant Prosecutor Angelo Onofri said the other driver, Camden resident Manuel Gutierrez Vazquez, 27, has been charged with DWI, one count of death by auto, two counts of assault by auto and one count of causing death or serious injury while unlicensed.

Onofri also said that Vazquez is not in the United States legally and has never possessed a U.S. driver’s license.

It is unclear if any additional charges will be filed against Vasquez. He is being held at Mercer County Correctional Center in lieu of bail, which was set by Superior Court Judge Patrick McManimon at $250,000 cash.
