HAMILTON — A city woman arrested in a fatal hit-and-run did not know she was leaving the scene of what would be a deadly accident, her lawyer said today.
Christina Rosario, 24, confessed to police that she struck 50-year-old Trenton resident Gary Gasior with her car on March 5, but before leaving, she checked the victim to make sure he was still alive, according to her attorney, John Furlong.
“She determined at the scene that the victim was OK,” he said. “There’s no way she would know it would become fatal.”
Gasior, who was struck near the corner of Liberty and Bernadine avenues, died two days after the incident, according to Hamilton police.
Furlong added that Rosario left the scene because she “felt threatened,” although he did not elaborate.
At a bail hearing today, prosecutors said that, along with leaving the scene of an accident resulting in death, Rosario was being charged with tampering with evidence, since she allegedly left the state to get the windshield of her white Acura Integra fixed after the accident.
According to Furlong, that information was provided to police by Rosario’s estranged husband.
He said her husband was also the one responsible for tipping police off to Rosario’s involvement in the accident.
She was arrested on April 16.
After reviewing the case, Mercer County Superior Court Judge Pedro Jimenez halved Rosario’s bail to $50,000 with a 10 percent option.
